§ 1 Defenition of terms

The person responsible:

According to Art. 4 No. 7 DSGVO, the person responsible is the one who decides on the purposes and means of processing personal data. Above all, they determine what, how and for what purpose the data is processed. They are responsible for the processing and must ensure that the data protection regulations are observed.

The initial processor:

According to Art. 4 No. 8 DSGVO, a processor is a service provider who acts on behalf of the data controller and processes personal data on their behalf.

Personal data:

Personenbezogene Daten sind gemäß Art. 4 Nr.1 DSGVO alle Informationen, die sich einer unmittelbar oder mittelbar bestimmbaren natürlichen Person („betroffene Person“) zuordnen lassen.

Processing:

According to Art. 4 No. 2 DSGVO, processing means all possible types of data processing. This includes in particular the collection, recording, organisation, arrangement, storage, adaptation, modification, reading, querying, use, disclosure, transmission, dissemination, linking, restriction, deletion or destruction of personal data.

The person concerned:

According to Art. 4 No. 1 DSGVO, the person concerned is the natural person to whom the data processed by the controller can be directly or indirectly assigned.

§ 3 When accessing our website

(1) Log-Files

As soon as you access our website under the URL www.qur.digital via the browser (e.g. Chrome, Firefox, Safari, etc.) of the terminal device used by you (e.g. desktop, smartphone, tablet, etc.), this automatically sends certain data to the server of our website and stores them there temporarily, i.e. for a limited time, in a so-called log file.

Processed data:

  • The IP-address of your terminal device;
  • Date and time of your request;
  • Content of your request (concrete page)
  • Access status/HTTP status code;

  • Website, from which the request originates (so-called referrer URL);
  • Browser type and -version;
  • Operating system, language and version of your browser software

Purpose:

This data is required by us in order to ensure a smooth connection to our website for you. Furthermore, this data enables us to monitor and evaluate our system security and stability.

Legal basis:

We base the legality of this data processing on Art. 6 Para. 1 lit.f DSGVO. The legitimate interest required for this follows from our desire to adapt our range of services to the needs of our customers in the best possible way and to offer a trouble-free user experience of our website.

Storage duration:

The storage period of log files is never longer than 14 days. Afterwards they are automatically deleted.

 

(2) Cookies

We use so-called cookies on our website. These are small text files which are automatically saved by the browser you use and stored on your end device. Cookies do not contain viruses, Trojans or other malicious software that could cause damage to the device you are using

Purpose:

Cookies enable us to recognise that you have already visited individual pages of our website or ensure that you do not have to make certain entries and settings that you have made within the framework of our website again.

Legal basis:

We base the legality of this data processing on Art. 6 Para. 1 lit.f DSGVO. The "legitimate interest" required for this follows from our desire to adapt our range of services to the needs of our customers in the best possible way.

Storage period:

The storage period depends on the type of cookie used. These are either deleted immediately when you end your visit to our website or only after a fixed period of time which we cannot determine. If you do not want cookies to be stored on your terminal device, you can restrict or completely deactivate this function in the settings of your browser. Please note, however, that completely deactivating the storage of cookies may mean that you cannot use all the services offered by our website.

 

(3) Use of Google Webfonts

We use Google Web Fonts on our website. This is a service provided by Google Inc. (1600 Amphitheatre Parkway Mountain View, CA 94043, USA, hereinafter referred to as "Google"), which enables the integration of various web fonts. This requires data to be transferred to a Google server in the USA. Google has subjected itself to the EU-US Privacy Shield.   • Anonymized IP address of your terminal device;
  • Date and time of your request;
  • Content pf your request (specific page);
  • Access status/HTTP status code;
  • Transferred data volume;
  • Website from which the request originates (so-called refferer URL)
  • Browser type and version;
  • Operating system, language and version of your browser software

Purpose:

Google Webfonts enables us to display the contents of our website uniformly in different browsers and on different end devices.

Legal basis:

We base the legality of this data processing on Art. 6 Para. 1 lit.f DSGVO. The "legitimate interest" required for this follows from our desire to adapt our range of services to the needs of our customers in the best possible way and to optimise our online presence.

Storage duration:

Since the browser you use automatically establishes a direct connection with the Google server, we have no influence on the extent to which Google collects data from you and stores it for further processing. We therefore inform you according to our current state of knowledge. You can find more information about Google Web Fonts at https://developers.google.com/fonts/faq and in the Google Privacy Policy, which you can view at https://policies.google.com/privacy.

 

§ 4 When receiving our Newsletter

As part of our range of services, we offer you the opportunity to register to receive our newsletter. For the administration of your data as well as the sending of the newsletter, we use the offer of MailChimp, a newsletter sending platform of The Science Group LLC (675 Ponce De Leon Ace NE #5000, Atlanta GA, 30308, USA, in the following called "MailChimp"). MailChimp is subject to the EU-US Privacy Shield. The active certification of MailChimp can be viewed at any time at https://www.privacyshield.gov/participant?id=a2zt0000000TO6hAAG.

Processed data:

  • Name;
  • Email address

Purpose:

MailChimp allows for us to organize the recipients of our newsletters, to design our newsletters and to evaluate them statistically.

Legality:

We base the legality of this data processing on art. 6 paragraph 1 lit. a DSGVO. You give your consent by actively registering for our newsletter and agreeing to the data processing in accordance with our data protection regulations by ticking the checkbox provided for this purpose. Please note that you can revoke your consent to us at any time in accordance with Art. 7 para. 3 DSGVO. In all other respects, we base the legality of this data processing on Art. 6 para. 1 lit.f DSGVO. Our "justified interest" follows from our wish to keep you informed about current news concerning our range of services.

Storage duration:

Your data will remain stored at MailChimp until you revoke your consent to receive our newsletter or object to receiving newsletters. Further information about MailChimp can be found in the privacy policy of MailChimp, which you can view at https://mailchimp.com/legal/privacy/.

 

§ 5 When contacting us

As part of our range of services, we offer you the possibility to contact us by e-mail, contact form or by telephone.

Processed data:

  • master data;
  • contact data;
  • address data;
  • content of the message;
  • payment data, if applicable

Purpose:

We need the data you provide in order to answer your request.

Legal basis:

We base the legality of this data processing on Art. 6 Para. 1 lit. a DSGVO. You give your consent by either actively sending us your enquiry or by contacting us via telephone and declaring your agreement to data processing in accordance with our data protection provisions by ticking the checkbox provided for this purpose or verbally on the telephone. Please note that you can revoke your consent, once given, at any time in accordance with Art. 7 Para. 3 DSGVO.

Storage duration:

In accordance with Art. 17 Para. 3 lit.b DSGVO in conjunction with Art. 17 Para. 3 lit.b DSGVO, the data transmitted by you for the purpose of concluding or processing a contract remains stored for the duration of the contract. § 147 Abs.3 AO in principle 10 years, beginning with the end of the contract (legal storage obligation).

 

§ 6 When using our online shop

As part of our service offer, we offer you the possibility to buy digital articles (e.g. guides in PDF format) in our online shop.

Processed data:

  • master data;
  • company data;
  • contact details;
  • payment data (invoice))

Purpose:

We need the data you provide us with in order to conclude and process a contractual relationship with you.

Legal basis:

We base the legality of this data processing on Art. 6 Para. 1 lit.b DSGVO, as it is absolutely necessary for the conclusion and processing of a contractual relationship with you.

Storage duration:

In accordance with Art. 17 Para. 3 lit.b DSGVO in conjunction with Art. 17 Para. 3 lit.b DSGVO, the data transmitted by you for the purpose of concluding or processing a contract remains stored for the duration of the contract. § 147 Abs.3 AO in principle 10 years, beginning with the end of the contract (legal storage obligation).

 

§ 7 When using our right to an online consultation hour

As part of our range of services, we offer you the possibility of using the online consultation hour Law, which we offer together with our cooperation partner Vorberg.Law, Am Kaiserkai 45, 20457 Hamburg.

We need the data you provide in order to make our range of services available to you.

Legal basis:

We base the legality of this data processing on Art. 6 Para. 1 lit. a DSGVO. You give your consent by actively sending us your enquiry and agreeing to the data processing in accordance with our data protection regulations by ticking the checkbox provided for this purpose. Please note that you can revoke your consent, once granted, at any time in accordance with Art. 7 para. 3 DSGVO.

Storage duration:

The data transmitted or communicated by you will remain stored by us until you revoke your consent to us in accordance with Art. 7 para. 3 DSGVO and no case of Art. 17 para. 3 DSGVO stands in the way of the deletion of your data.

 

§ 8 Integration of third party content

Under certain circumstances, we may include third-party content on our website, such as videos, maps, RSS feeds or graphics. The integration of this content requires that the providers of this content (hereinafter referred to as "third party providers") are aware of your IP address, as otherwise the content cannot be sent to the browser you are using.

We make every effort to use only content from such third party providers who use your IP address solely for the purpose of delivering the content. However, we have no influence on whether third parties process your IP address for further purposes, such as statistical analysis. As far as we become aware of such a procedure, we will inform you accordingly within the scope of these data protection regulations.

You have the possibility to prevent the processing of your data by downloading a browser add-in and installing it in the browser you use, which blocks Java Scripts. You can also deactivate the use of Java Scripts in the settings of the browser you use.

 

§ 9 Integration of social media links

Under certain circumstances, we use links on our website to social media platforms (e.g. Facebook, Instagram etc.). By clicking on the appropriate link (e.g. via a corresponding icon) you will be redirected to our profile on the respective linked social media platform. The direct contact and thus also the data exchange between you and the respective social media platform is - in contrast to the use of conventional web plug-ins - only established when you actively click on the respective link. In this respect, we do not process your data in accordance with the DSGVO.

§ 10 Transfer of data to third parties

We will only pass on your data to third parties if

  • you have given your expressed consent to this in accordance with Art. 6 Para. 1 letter a DSGVO;
  • the disclosure pursuant to Art.6 para.1 lit.f DSGVO is necessary for the assertion, exercise or defence of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data;
  • we are legally obliged to pass on the data in accordance with Art.6 para.1 lit.c DSGVO;
  • the transfer of your data is necessary for the processing of a contractual relationship with you in accordance with Art. 6 para. 1 lit.b DSGVO.

 

§ 11 Your rights as an affected person

As a person affected within the meaning of Art. 4 No. 1 DSGVO, you are entitled to rights which are explicitly regulated in the DSGVO and which are indispensable (rights of data subjects). You, therefore, have the right

  • in accordance with Art. 15 DSGVO to be informed about which data of yours we'll store;
  • pursuant to Art 16. DSGVO, to demand  the immediate correction or completion  of the data we have stored on you;
  • pursuant to Art 17 para. 3 DSGVO to demand the deletion of the data we have stored on you;
  • pursuant to Art. 18 DSGVO, to demand the restriction of the processing of the data we have stored on you, if the conditions of Art. 18 Para. 1 lit.a-d DSGVO are fulfilled;
  • pursuant to Art. 20 DSGVO, to demand the unhindered transmission of the data we have stored on you in a structured common and machine-readable format (e.g. as PDF);
  • pursuant to Art. 21 DSGVO, to object to the processing of your data if we process them on the legal basis of Art. 6 para. 1 lit.f DSGVO (legitimate interest) and your objection arises from a special situation or is directed against direct advertising. in the latter case, you can also object to the processing without any reason
  • pursuant to Art. 7 pra. 3 DSGVO, to revoke your consent to data processing any time;
  • lodge a complaint with the competent supervisory authority pursuant to Art. 77 DSGVO

§ 12 Storage location and integration of service providers

Your data will be stored and processed exclusively in security-certified computer centres within the European Union. We reserve the right to make use of various service providers (contract processors) for the storage and processing of your data, but these service providers will only work on our behalf and in accordance with our instructions. We will oblige the service providers employed by us to take technical and organisational measures which are suitable according to the current state of the art to ensure that your data is processed in accordance with data protection regulations. Under no circumstances will your data be passed on or sold to third parties by our service providers.

 

§ 13 Data protection

In order to ensure the best possible protection for your data transmitted to us, we use so-called Secure Socket Layer Encryption (SSL encryption for short) on our website. This encryption ensures that the data transmitted by you cannot be read, redirected or changed by unauthorized third parties during transmission.

 

§ 14 Changes within our data protection

We reserve the right to change these data protection regulations at any time with effect for the future, for example to react to the further development of our range of services or a changed legal situation. We expressly point out that your rights as a person affected in accordance with the DSGVO will never be restricted by a change.
